Lewd law up for revision
City says amendments not related to bikini barista bust

EVERETT - A new version of the city’s “lewd conduct ordinance” would define lewd acts and add businesses with a “drive-up window” to the list of places where those acts are prohibited.
The Everett City Council will vote on the revised ordinance at its Sept. 30 meeting.
City spokeswoman Kate Reardon called the revised ordinance part of an ongoing “housekeeping” effort.
“We’re eliminating gray areas, and we’re updating the language to reflect current times,” Reardon said. “We do this all the time.”
While the proposed ordinance does not change city laws, it specifies what lewd acts are and where they are banned.
After Everett police busted several women for prostitution at a Broadway bikini espresso stand, public discussions on the lewd ordinance have centered on these stand-alone stores, where bikini-clad baristas bring in big business.
The women involved in the Broadway stand have been charged with prostitution and violating the city’s adult entertainment ordinance, according to media reports. The city said the lewd conduct revisions are not related to the Broadway bust, which has made national headlines.
The new rules relating to lewd conduct would specify that businesses “which can serve customers who remain in their vehicles by means of a drive-up window,” including bikini barista stands, are public places where “exposure or display” of the genitals is prohibited.
At this week’s meeting, the City Council will hear public comment before deciding to approve, amend, reject or table the ordinance.
